Le 28 avril, le premier Ministre a envisagé un retour à l’école, au Collège et au Lycée, organisé selon le principe du volontariat. Pas celui des personnels bien sûr…tous doivent obligatoirement retourner travailler le 11 mai. OK, mais dans quelles conditions et selon quel plan de retour à l’activité?


Le CHSCT du 29 avril ne nous incite pas plus à l’optimisme que ce que nous avons pu observer lors du déroulement de la phase de confinement. Pour l’instant, la DASEN n’a aucun plan de retour à l’activité à présenter au CHSCT. La faute à Blanquer : les DSDEN n’avait pas encore reçu le protocole national de réouverture des écoles et établissements scolaires.


Ce protocole servira de cadrage global à la sécurisation des environnements de travail. ll faudra le décliner selon les spécificités locales. La seule chose que la DASEN nous a appris c’est que des masques chirurgicaux seront fournis aux personnels à partir du 6 mai. Elle ignore combien.

Rappelons que ces masques ne protègent pas leurs porteurs et que les élèves de l’école primaire n’en disposeront pas, sauf si leurs parents les en équipent.

Pour le gel hydro-alcoolique, pas d’information.

Pour les personnels RASED et AESH qui travaillent dans une proximité physique appuyée avec les élèves Mme la DASEN envisage de leur fournir un équipement avec visière.

Mme la DASEN nous a indiqué que des directeurs et directrices d’école étaient actuellement impliqué-es dans un travail avec leurs interlocuteurs municipaux pour organiser le retour à l’école des élèves.

Cette information est inquiétante : la loi prescrit à l’employeur d’organiser le travail, c’est sur lui que repose cette responsabilité qui comporte des aspects civils et pénaux. Or, dans l’état actuel cette organisation est une auto-organisation assurée par les personnels de direction, là où elle a lieu (mais Mme la DASEN n’a pas fourni de précisions géographiques).

Cette autonomie est dangereuse : qui, en cas de contamination, assurera la responsabilité civile et pénale? D’autre part, de quelle formation en la matière les personnels disposent-ils?

Interrogée sur le risque professionnel le 11 mai, Mme le Médecin de Prévention a clairement affiché sa prudence : « le risque zéro n’existe pas ». C’était le minimum quand on connaît la position de ses homologues du Conseil scientifique Covid 19.(1)


Le recensement des élèves qui seront accueillis sera assuré par les Maires et non les Directeurs d’école. C’est ce que Mme la Préfète indiquera lors d’une réunion qui doit se tenir le 30 avril 2020.


Même s’il n’y aura pas de simultanéité du travail distanciel et présentiel, il faudra malgré tout organiser un travail distanciel pour les élèves des familles refusant de
mettre leurs enfants à l’école. Quid de l’organisation? Là aussi comme sur tous les points précis abordés par les représentants du personnel, tout est à l’état de réflexion…

Point médical important : les enseignants présentant une contre-indication médicale à la reprise du travail doivent contacter le médecin de prévention et lui demander de préconiser une mesure d’éloignement du poste afin de pouvoir se placer en télétravail. Cela en lui fournissant simplement un document du médecin traitant. Si son conjoint présente une fragilité spécifique, l’agent peut effectuer la même démarche : il bénéficiera de la mesure d’éloignement. (2)

Ce CHSCT a été pauvre en annonces et quasiment vide pour ce qui est des décisions de sécurisation des personnels. Une seule chose positive : les représentants du personnels ont demandé la tenue d’un groupe de travail le mercredi 6 mai afin d’examiner le plan de retour à l’activité que la DASEN doit être
en mesure de soumettre au CHSCT à cette date. A cette occasion c’est toujours la même question que nous nous poserons :

Les lieux de travail seront-ils sains et sécurisés le 11 mai?
